A graduate transfer must count against the 25-man limit if he is an initial counter -- first time signee. Virtually every graduate transfer is coming from a Division I school, so he has already been an initial counter at his first school. Tracy is coming from a Division II school, so he has never been an initial counter. Therefore, the first time he comes to a Division I school as a signee, he must be an initial counter and goes against the 25-man limit.

The rule is pretty clear. LSU should have known that Tracy was going to count -- assuming they knew he was only at a Division II school. This is a NCAA rule. LSU may have asked the SEC office for their opinion of the situation, but it is not a decision made by the conference.
