evolving. The "BIG BOY " league is moving ahead. An institution wants in, then sign the agreement. Being put together by the SEC, Big 10, ACC, and one other league (PAC 12). The contract appears to be legally binding , states can't side step NIL, members agree not to sue. If an institution doesn't follow the rules they are out the fraternity. From what I read it seems the process is what I predicted needed to happen years ago.
